City of Eagan Statement on Gopher Resource Class Action Settlement Notice

- The City of Eagan has been informed by Gopher Resources that approximately 425 households near the Gopher Resource facility will soon receive a legal notice regarding a class action settlement.

A Florida state court approved the settlement, which involves Gopher Resource facilities in both Eagan and in Tampa, Florida, related to alleged harmful emissions. Individuals who lived, worked, or attended school within one mile of the Eagan facility stack between Jan. 1, 2000, and July 24, 2024, may be eligible to participate.

This settlement is separate from the Minnesota Pollution Control Agency’s (MPCA) findings of elevated lead levels identified in early 2025 and the City’s ongoing discussions with residents and state regulators this year.

The court previously directed a third-party administrator to mail notices to households within one mile of the facility. Due to an administrative error, about 425 households did not receive the original mailing according to Gopher Resources. Those households are now receiving the notice to ensure all potentially affected residents have the same information.

Mayor Mike Maguire stated:

“We want residents to have clarity about this notice. It is connected to past activities, before the MPCA identified elevated lead levels in 2025. While this is a court-managed process, we remain committed to transparency and helping our community know where to direct questions and get accurate information.”

The City of Eagan is not a party to the lawsuit. The letter includes instructions and contact information for the settlement administrator. Residents should use that information if they have questions about the settlement.
