Cannabis Information and Retail Registration

Minnesota passed a new law in 2023 legalizing adult-use cannabis (21 and older), establishing a regulatory framework for the cannabis industry. The law established the Office of Cannabis Management (OCM) to oversee applications, issue licenses, and establish regulations for cannabis.

Use of Cannabis in Public Places

As of August 1, 2023, cannabis use is legal in private residences, on private property unless prohibited by the owner, or other premises licensed for on-site consumption.

No person shall use cannabis flower, cannabis products, lower-potency hemp edibles, or hemp-derived consumer products within public property or in a public place such as City buildings, parking lots, parks, pathways and trails, and city rights-of-way consisting of roadways, abutting boulevards, sidewalks, and trails. Retail Adult-Use Cannabis

All applications will be processed on a first-come, first-served basis and will be limited to the number of registrations as defined by ordinance. The supplemental handout and application outline the documentation required at the time of submission.

Applicants will receive Pre-Approval from the City and secure the ability to work with City staff to submit required building permits for the new retail space and complete required inspections. Once a Certificate of Occupancy is issued for your retail location, payment will be required at that time, and a final Retail Registration will be issued.

Lower-Potency Hemp Edible Retailers

Per Minnesota Statute, all establishments (including exclusive liquor stores) that sell Hemp-Derived Cannabinoid Products (HDCPs) must convert their registration to a license via the online licensing portal with the State of Minnesota if they intend to continue retail sales.

Registration to License Conversion

All Lower-Potency Hemp Edible Retailers (LPHE) that hold a Registration from the State must convert their Registration to a License on the Office of Cannabis Management’s webpage during October 1 through October 31st, 2025. A business that decides not to convert to or apply for a license will no longer be legally allowed to sell HDCP’s. Additional links below for more information related to the licensing process.

Once you hold a valid Lower-Potency Hemp Edible License issued by the State, you must register with the City of Eagan. A link to the application is below. There is no limit to the number of retail registrations for Lower-Potency Hemp Edible Retail Registrations.
